EMS Logic, Inc. respects the privacy of its visitors, guests and customers.

Information Gathered
All information submitted, or gathered via log files, is considered confidential and shall not be given or sold to any third parties. If you opt to subscribe to any portion of the site your email address will be put on our mailing list for notification of updates. Should you wish to be removed from this list, send email to support@emslogic.com indicating you would like to be removed.

Cookies
Cookies are used on this site only to maintain session variables which determine access rights. One, and only one, cookie will be placed on your computer by our server. This one cookie is a number which is your session ID. This session ID is used for security and access purposes. All other session variables are stored on the server for the duration of your session.

Security
We utilize state of the art technology, including firewall and key encryption software. We will not disclose any product specific information for security reasons, however we utilize hardware based firewalls, private subnets, intrusion detection and self assessment tools. The weakest link is the username and password you select. Using a short guessable password is by far the greatest weakness. We have not encountered any breach of security during our many years of involvement with corporate networks and internet services. You can be comforted by recognizing that the information available from this website is not of great interest to those who may devote time to "hacking".

Indemnification
EMS LOGIC, INC., SITE USER LICENSE AND HOLD HARMLESS AGREEMENT

PURPOSE OF THIS AGREEMENT: This agreement establishes the agreed terms under which you, the user, may access the EMS Logic, Inc. SITES (www.emslogic.com, msdslogic.com, labellogic.com, ohsalogic.com). Supplemental agreements relate to specific EMS Logic, Inc. software products.

IMPORTANT: READ CAREFULLY - The EMS Logic Inc. SITES (www.emslogic.com, msdslogic.com, labellogic.com, ohsalogic.com) component(s), including any "online" or electronic documentation ("Components"), are subject to the terms and conditions of this agreement (SITE USER LICENSE AND HOLD HARMLESS AGREEMENT or "SULHHA"). By registering, accessing, using, installing, copying, or otherwise using the SITES or the component part(s) thereof, you agree to be bound by the terms of the SULHHA. If you do not agree to the terms of this Supplemental SULHHA, do not register, access, install, copy or use the Components of the SITES.

NOTE:  IF YOU HAVE NOT AGREED TO A VALID "SULHHA", YOU ARE NOT AUTHORIZED TO ACCESS, INSTALL, COPY OR OTHERWISE USE THE COMPONENTS OF THIS SITE AND YOU HAVE NO RIGHTS UNDER THIS SULHHA.

GENERAL: EMS Logic, Inc. grants you a license to use the SITES or any portion thereof, by the individual users you designate via the registration process and subscription process.

EMS Logic, Inc. grants you, as a valid license holder of the SITES, the right use and download information contained in this website for the location(s) identified in your registration.  Excluding data entry as intended by the software, no modification to the EMS Logic, Inc. Central Server or software may be made by you or on your behalf by you or your designee.


Disclaimer of Warranties.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMS LOGIC, INC., AND ANY (IF ANY) SUPPORT SERVICES RELATED TO THE COMPONENTS ("SUPPORT SERVICES") AS IS AND WITH ALL FAULTS; AND EMS LOGIC, INC. AND ITS SUPPLIERS HEREBY DISCLAIM WITH RESPECT TO THE COMPONENTS AND SUPPORT SERVICES ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY (IF ANY) WARRANTIES OR CONDITIONS OF OR RELATED TO:  TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, LACK OF VIRUSES, ACCURACY OR COMPLETENESS OF RESPONSES, RESULTS, LACK OF NEGLIGENCE OR LACK OF WORKMANLIKE EFFORT, QUIET ENJOYMENT, QUIET POSSESSION, AND CORRESPONDENCE TO DESCRIPTION. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE COMPONENTS AND ANY SUPPORT SERVICES REMAINS WITH YOU.

Exclusion of Incidental, Consequential and Certain Other Damages.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EMS LOGIC, INC. OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR:  LOSS OF PROFITS, LOSS OF CONFIDENTIAL OR OTHER INFORMATION, BUSINESS INTERRUPTION, PERSONAL INJURY, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY (INCLUDING OF GOOD FAITH OR OF REASONABLE CARE), NEGLIGENCE, AND ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE COMPONENTS OR THE SUPPORT SERVICES, OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS SUPPLEMENTAL SULHHA, EVEN IF EMS LOGIC, INC. OR ANY SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Limitation of Liability and Remedies. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED ABOVE AND ALL DIRECT OR GENERAL DAMAGES), THE ENTIRE LIABILITY OF EMS LOGIC, INC. AND ANY OF ITS SUPPLIERS UNDER ANY PROVISION OF THIS SUPPLEMENTAL SULHHA AND YOUR EXCLUSIVE REMEDY FOR ALL OF THE FOREGOING SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE COMPONENTS OR U.S. $5.00. THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.

User, for itself, its heirs, administrators and assigns, does hereby agree to protect, indemnify, assume and hold harmless, and does hereby release and forever discharge EMS Logic, Inc., its officers, employees, representatives, successors and assigns, from and against any and all claims, and demands, causes of action, suits and proceedings (reasonable costs and attorney fees included), including any claims by third parties, from and against any demand, claim, penalty, liability, and cause of action, suit, damage, judgment, loss, cost, or expense arising out of the use of this product.
